Terms of Service

1. The service

Downwind Buddy ("the App") is a community platform for downwind foil sports: ride invites, group logistics, chat, session recording, weather tools and a used-gear marketplace. The App is operated by [Company name] with its registered office in Poland ("we", "the Operator").

2. Account

You must be at least 16 years old to create an account. You are responsible for keeping your credentials confidential and for all activity under your account.

3. Paid products

The App offers paid digital products: Weather Pass (72-hour access), Organiser Pass (one-off, tied to a specific invite, or monthly subscription) and marketplace promotions. Prices are shown before purchase and include VAT where applicable. Purchases made in the iOS or Android app are processed by the respective app store; purchases on the web are processed by our payment provider.

4. Withdrawal from digital content

Under Article 38 point 13 of the Polish Consumer Rights Act, the right of withdrawal does not apply to digital content supplied immediately with your express consent and acknowledgement that you lose the right of withdrawal. By activating a pass you expressly consent to immediate delivery.

5. Marketplace

The marketplace connects private sellers and buyers of used water-sports gear. With the Downwind Protection (escrow) option, payment is held until delivery is confirmed; a 5% service fee applies. We are not a party to the sale contract between users.

6. User content and conduct

• You retain rights to content you post; you grant us a licence to display it in the App.
• No unlawful, misleading or dangerous content; no spam or commercial abuse.
• Ride organisers are responsible for the accuracy of their listings and logistics.

7. Liability

Weather forecasts, route scores and gear advice are informational only and may be wrong. Downwind sports are inherently dangerous — you ride at your own risk. To the extent permitted by law, our liability is limited to the amount you paid us in the last 12 months.

8. Complaints and law

Complaints: [contact e-mail]. These terms are governed by Polish law; consumers keep the protection of their country of residence. EU consumers may use the ODR platform.
